TERMS OF SERVICE

1. General Usage

The Swingman Rangefinder uses class 1 lasers to detect distances of objects and surfaces in generally clear conditions, as well as Bluetooth as a method of communicating with other devices. Swingman devices are designed to be used on a golf course for golfing purposes. 

We work hard to ensure the most accurate information possible is displayed in Swingman devices. However, Grint LLC does not guarantee complete accuracy and shall not be liable for any event, issue, or otherwise, caused by any inaccuracy of our GPS services or laser measurements, especially in abnormal environmental conditions or outside the golf course or golfing activities. Users agree to use Swingman devices at their own risk.

2. Personal Injury Risk of the Swingman Rangefinder

The Swingman Rangefinder is intended to be used in accordance with the user manual provided with the device. Although there is a very low risk of damage or injury while using the Swingman Rangefinder, neither Swingman nor Grint LLC are responsible for any damage to personal property or injury to yourself or others, especially due to improper or unprescribed use. To reduce the risk of damage or injury, take these precautions while exercising general and common safety practices: 

• Do not look at the laser sending or receiving lens while using the rangefinder

• Do not aim or point the rangefinder at other people while using the device

• Do not place the magnetic mount onto surfaces or near objects that may be damaged or harmed by a magnet (e.g., credit cards, hotel keys, pacemakers, etc.) 

• Use the charging cable that came with the device

• Do not remove or attempt to remove the battery from the device

• Do not use device if there is evidence that the battery may be compromised

3. Data usage policy of the Swingman Rangefinder

Certain data are captured from the rangefinder and may be transferred to and managed by TheGrint app and are subject to the data usage rights and privacy policy of Grint LLC. Currently, Swingman devices do not permanently store measurement data, user data, or app information originating from TheGrint applications or user accounts. New data will not be collected, used, or inferred by Swingman devices or TheGrint app while devices are not paired/connected to the App. 

Data will 

These Data may be captured by the Swingman Rangefinder and sent to TheGrint app when connected to TheGrint app on a compatible device:

• Device Identifiers, including device name, service UUIDs, characteristic UUIDs, and serial numbers, used for pairing and communicating with connected devices

• Measured distance values generated from the laser measuring device

• Measurement unit type, such as yards or meters

• Device event information, including timestamps, power-on, button actions, flag lock, sleep mode, etc.

• Values calculated on the device, including slope-adjusted distances and relative pin location values, when applicable

These data may be sent from TheGrint app to the Swingman Rangefinder for temporary use (not permanently stored on device):

• Golf round information, including but not limited to golf course data points, hole numbers, 

• GPS location data based on permissions established by TheGrint app

• User information related to golf round, potentially including scoring indices (e.g., USGA Handicap Index) 

How We Use Your Personal Information

• - Providing Products and Services. We use your personal information to provide you with the Services in order to enable the expected features in the Swingman devices and TheGrint app, including front, back, and center GPS data, Relative Pin Position, shot tracking capabilities, and others.  
• Marketing and Advertising. We may use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you advertisements for products or services. This may include using your personal information to better tailor the Services and advertising on our Site and other websites.
•   Security and Fraud Prevention. We use your personal information to detect, investigate or take action regarding possible fraudulent, illegal or malicious activity. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately..

• Communicating with You and Service Improvement. We use your personal information to provide you with customer support and improve our Services. This is in our legitimate interests in order to be responsive to you, to provide effective services to you, and to maintain our business relationship with you

Terms and Conditions 

WARRANTY

Swingman products purchased from TheGrint Shop or authorized affiliates include a warranty from the date of purchase based on the product you purchased.

One Year Warranty – Swingman Rangefinder

No Warranty - Apparel, Hats, Accessories, or “TheGrint” Branded accessory items.

This warranty covers manufacturing and operational defects only. Damage sustained from usage is not covered under the warranty. If you have any questions regarding the warranty on Swingman devices, please email contactus@swingman.golf.

Warranty is valid only with the order number and matching email address to the order placed.

 

SWINGMAN CONNECTIVITY TO THEGRINT APP

Swingman devices can connect via Bluetooth to TheGrint app on devices with up-to-date Android or Apple operating systems. The connection utilizes a proprietary protocol that sends and receives data to and from TheGrint app while paired with your device. For data managed by TheGrint app, see TheGrint app's Privacy Policy or email shop@thegrint.com for more information.

Swingman Rangefinder Usage with TheGrint PRO Member Access:

TheGrint user accounts with an active and valid TheGrint PRO Membership will be able to access all data and features enabled through connecting the Swingman Rangefinder to TheGrint app (unless otherwise specified in TheGrint feature releases), including new features that are not yet released. These features include, but are not limited to:

• Distance values to the Front, Center, and Back of the putting green, visible in the rangefinder's viewfinder

• Relative Pin Position icons, visible in the rangefinders viewfinder

• TheGrint app features that rely on data sent from the Swingman Rangefinder to TheGrint app

• Special PRO Member pricing (Currently as of Jul 25, 2024 is $149.99 after an applied discount code during checkout)

Swingman Rangefinder Usage with TheGrint "Free Member" Access:

User accounts without an active TheGrint PRO Membership ("Free Members") will not be able to access the connected features of the Swingman Rangefinder, listed above.

The Swingman Rangefinder will still be able to perform the following tasks: 

• Direct distance measuring

• Slope-adjusted distances

• Flag Lock Jolt

• Standard Retail Pricing (Currently as of Jul 25, 2024 is $299.99) which includes a 1-year TheGrint PRO Membership

Device pairing and device data transfer to TheGrint app and database will continue as long as the device is paired with TheGrint app, even when the user is not a PRO member and features are not visible to the user. 

Data gathered during any period of time in which the user had an active and valid TheGrint PRO Membership will be retained for use by the user, where applicable (e.g., shot states, distance stats, etc.). 

All data usage by TheGrint is subject to the conditions in TheGrint app's Privacy Policy. Email shop@thegrint.com for more information.

RETURNS & EXCHANGES

If customers are not satisfied with their order within the first 30 days after receiving the item based on the Return Policy, they can simply return it to us in like-new condition, and we will gladly accept it for a return or exchange.

In order to process a return customers will need to provide an order number & customer name in an email sent to shop@thegrint.com.

Customer Returns in US for Orders Placed on TheGrint Shop Website:

• US Customers who have purchased from TheGrint Shop can return or exchange products free of charge, without paying for shipping, by contacting TheGrint Shop at shop@thegrint.com

Customer Returns in US for Orders Placed in other channels:

• Currently, the Swingman Rangefinder is sold solely through TheGrint Shop website. Returns to the Shop are therefore only authorized if purchased through TheGrint Shop website. TheGrint Branded products or Swingman Branded Products that are purchased from a channel other than TheGrint Shop Website are not eligible for returns to TheGrint Shop and must be handled directly with the sales channel. 

International Customers:

TheGrint Shop does not currently ship to international customers (outside the United States) at this time. Please reach out to shop@thegrint.com for any questions regarding a gifted item or custom international orders. 

• For gifts or custom international orders, please contact shop@thegrint.com - please note that international customers are responsible for the cost of shipping, duties, custom fees, and taxes on returned or exchanged items to Swingman or TheGrint Shop.

• International Customers should contact shop@thegrint.com in order to open a return or exchange.

We suggest using a shipping service with a tracking number when customers return the product. Refunds are usually processed within two business days of receiving their return.

If an item is received as a gift, please include any information from the original order – the order number, the name or email of the person who ordered the gift, etc – and we will make sure the request is properly handled.


DOMESTIC SHIPPING & RETURNS

We ship via USPS to locations within the United States, including Alaska and Hawaii. Orders are processed within 1-3 business days. Terms of pre-sales will be available on the website in the product listing, as applicable. Typically, standard U.S. shipping takes 4-7 business days but can vary based on delivery location. We reserve the right to change carriers without notice or changes to this document. 

PRICE & BILLING

We reserve the right to change pricing at any time for any reason. We reserve the right to not honor typographical errors which may cause incorrect pricing on the website. The full amount is charged when you place your order.

From time to time, users may receive special discounts through The Drop Zone in TheGrint app or through other methods. Discount conditions and deal terms will be available in the wording and/or copy of TheGrint Shop website. Unauthorized use or abuse of discount codes may result in order cancellations or other actions at the discretion of TheGrint Shop.

We at Grint LLC respect the privacy of your personal information and, as such, make every effort to ensure your information is protected and remains private. As the owner and operator of www.thegrint.com (the "Website"), our mobile application TheGrint (the "App"), TheGrint Shop (the “Shop”), and Swingman products (the “Device”), hereafter referred to in this Privacy Policy as "TheGrint", "us", "our" or "we", we have provided this Privacy Policy to explain how we collect, use, share and protect information about the users of our Swingman devices (collectively referred to as “user” or “you”). For the purposes of this Agreement and our Terms of Service, any use of the terms "TheGrint", "us", "our" or "we" includes Grint LLC, without limitation. We will not use or share your personal information with anyone except as described in this Privacy Policy.

This Privacy Policy will inform you about the types of personal data we collect, the purposes for which we use the data, the ways in which the data is handled and your rights with regard to your personal data. Furthermore, this Privacy Policy is intended to satisfy the obligation of transparency under the EU General Data Protection Regulation 2016/679 ("GDPR") and the laws implementing GDPR.

For the purpose of this Privacy Policy the Data Controller of personal data is Grint LLC and our contact details are set out in the Contact section at the end of this Privacy Policy. Data Controller means the natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal information are, or are to be, processed.

For purposes of this Privacy Policy, "Your Information" or "Personal Data" means information about you, which may be of a confidential or sensitive nature and may include personally identifiable information ("PII") and/or financial information. PII means individually identifiable information that would allow us to determine the actual identity of a specific living person, while sensitive data may include information, comments, content and other information that you voluntarily provide.

TheGrint collects information about you when you use our Website or App to access our services, and other online products and services (collectively, the “Services”) and through other interactions and communications you have with us. The term Services includes, collectively, various applications, websites, widgets, email notifications and other mediums, or portions of such mediums, through which you have accessed this Privacy Policy.

We may change this Privacy Policy from time to time. If we decide to change this Privacy Policy, we will inform you by posting the revised Privacy Policy on the Site and in the App. Those changes will go into effect on the "Last updated" date shown at the end of this Privacy Policy. By continuing to use the Site or Services, you consent to the revised Privacy Policy. We encourage you to periodically review the Privacy Policy for the latest information on our privacy practices.
